Claims Prevention

D&B’s systematic approach to construction claim prevention is to encourage settlements when at all possible, with the ultimate goal of resolving disputes before they lead to arbitration or litigation procedures. During a project’s construction phase, the following are essential to mitigating claims and ensuring overall project success:

  • Thorough understanding of requirements, objectives and intent of contract documents.
  • Implementation of a document control system to capture, code and file all construction-related documents properly.
  • Pre-construction meetings to reach agreements on key project objectives.
  • Prioritization of each objective by relative importance.
  • Clear definition of each party’s roles and responsibilities.
  • Allocation of risks to the party best able to control them
  • Provision of equitable reward for risk assumption.
  • Performance criteria to communicate expectations and measure each party’s progress.
  • Coordination of activities involving multiple parties.
  • Implementation of cost, schedule and quality control procedures.
  • Periodic progress reviews and inspections.
  • Maintenance of open communications throughout the project.
  • Timely response by all parties during the course of the project.
